1. About BoulardTV Creators

BoulardTV Creators ("the Service", "we", "us") is a membership and content platform that lets creators share exclusive content with their audience and earn a living through subscriptions, paid posts, tips, and direct messages. In the same spirit as platforms like Patreon, we connect creators with the fans who choose to support them.

By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not accept these terms, please do not use the Service.

The Service is reserved for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account, subscribe, or publish content. By using the Service, you confirm that you meet this requirement.

2. Creator Accounts & Content

Creators are independent and solely responsible for the content they publish. We provide the tools to host, distribute, and monetize that content, but we do not create it and we disclaim any liability for content uploaded by creators or members.

• Each creator is fully responsible for the legality of their content and for holding all required consents, releases, and rights for every person appearing in it.
• All content must involve only consenting adults. We strictly prohibit any content involving minors (CSAM), non-consensual material, or anything otherwise illegal. We report and cooperate with the relevant authorities.
• You may not impersonate another person or publish content you do not own or have the rights to use.
• You agree not to hold BoulardTV Creators or its operator liable for any direct or indirect damages arising from your use of the Service.

3. Acceptable Use Policy

To keep the Service safe and compliant with our payment partners, the following content and conduct are strictly prohibited, regardless of consent. Posting any of the following will result in immediate removal, account termination, withholding of funds, and, where required, a report to the authorities:

• Any content depicting, suggesting, or sexualizing minors, or any person who appears to be under 18, including fictional, animated, or AI-generated depictions.
• Non-consensual content of any kind, including content shared without the depicted person's consent ("revenge" content), hidden-camera or voyeur material, and depictions of rape or coercion.
• Content involving real, non-simulated violence, blood, mutilation, torture, or that depicts serious physical harm.
• Content depicting incest or family relationships, bestiality or animals, necrophilia, or bodily waste.
• Content that promotes, facilitates, or advertises human trafficking, sex work solicitation, escort services, or prostitution.
• Drugs, weapons, or any illegal goods or services; hate speech, harassment, threats, or content that incites violence against a person or group.
• Spam, scams, phishing, malware, or any attempt to defraud other users or the Service.

Every person appearing in content must be a verified, consenting adult, and creators must be able to provide proof of age and consent on request. We may remove content, suspend accounts, and withhold funds at our discretion to enforce this policy.

4. Wallet & Adding Funds

To support creators, members add funds to their account wallet using a secure payment provider. Wallet funds are spending credit that can be used to subscribe to creators, unlock paid posts, send tips, or pay for messages.

• Wallet top-ups are not withdrawable and are non-refundable. Once you add funds, they remain as credit to spend on the Service. They cannot be converted back to cash or returned to your card on request.
• Wallet credit has no cash value outside the Service and does not earn interest.
• You are responsible for the amount you choose to add. Please only add what you intend to spend.
• Payment-processing fees charged by our provider may apply at the time you add funds and are disclosed at checkout.

5. Creator Earnings, Platform Fee & Payouts

When a member spends on a creator, the creator receives earnings net of our platform fee. Only creator earnings are withdrawable, not wallet top-ups.

• We retain a platform fee of 10% on each creator transaction. The remaining 90% is credited to the creator's withdrawable earnings.
• Creators must complete identity verification (KYC) and connect a payout account before any withdrawal.
• Earnings become available for withdrawal once the underlying payments have cleared with our payment provider, which can take a few days after a member pays.
• A minimum withdrawal amount may apply, as shown in your dashboard.
• Chargebacks, fraud, or breaches of these terms may result in the withholding of funds and suspension of payouts.

6. Subscriptions & Renewals

Subscriptions to a creator renew automatically for the same period until you cancel them. You can cancel at any time from your subscriptions page; cancellation stops future renewals and you keep access until the end of the current paid period.

• Prices are set by each creator and shown before you subscribe.
• It is your responsibility to cancel before a renewal if you no longer want it.

7. Refunds & Disputes

Because content is delivered digitally and instantly, and because creators are paid from member spending, all purchases are final and non-refundable, including wallet top-ups, subscriptions, paid posts, tips, and paid messages, except where a refund is required by applicable law.

If you believe a charge was made in error or without your authorization, contact us first at the address below so we can investigate. Initiating a chargeback without contacting us may lead to suspension of your account.

8. Moderation & Copyright

We may remove any content at any time, without prior notice, if it violates these terms or applicable law. We respond to valid copyright notices and will remove infringing material. For copyright concerns, contact us at the address below.

9. Account Suspension & Termination

We may suspend or terminate any account that breaches these terms, engages in fraud, or puts the Service or its users at risk. Where funds are involved, we will handle them in accordance with these terms and applicable law.

10. Limitation of Liability

The Service is provided "as is". To the maximum extent permitted by law, BoulardTV Creators and its operator are not liable for any indirect, incidental, or consequential damages, or for content published by creators or members.

11. Changes to These Terms

We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
